JANDSON HOMES – BINGARA GORGE DREAM LEGO HOME COMPETITION (GAME OF SKILL) TERMS & CONDITIONS

 

  1. The Supplier is Jandson Homes (Jandson PTY LTD) Address: Gateway Business Park, Suite 402, 63 Parramatta Road, Silverwater, New South Wales, Australia, 2128. ABN: 55 003 144 330  Builders License: 37957
  2. Only residents of Australia aged 3 or older (Participant) are eligible for the Competition. Participants under 18 years of age must obtain the prior permission of a parent or guardian over the age of 18 years to enter the Competition, evidenced by either: i) the parent or guardian notifying the Bingara Gorge Facebook page via Facebook Messenger; or  ii) the parent or guardian posting the competition entry to the Bingara Gorge Facebook page via the parent or guardian’s own Facebook account.
  3. The following person(s) are ineligible to enter the Competition:
  • employees of:
  • the Supplier; and
  • the Supplier’s related bodies corporate (as that expression is defined in the Corporations Act 2001 (Cth),

and associated agencies, companies and contractors; or

  • members of the Immediate Families of the employees referred to at paragraph 3(a).

Immediate family means any of: a spouse or domestic partner, ex- spouse or ex-domestic partner, de-facto spouse or ex-de-facto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin.

  1. The Competition commences at 7:00PM on 26/05/2020 and closes at 11:59PM on 9/06/2020 (Competition Period). The Promoter may extend the Completion Period at its sole discretion (Extended Competition Period).  Details of any Extended Competition Period will be posted on the Bingara Gorge Facebook page (https://www.facebook.com/bingaragorge/)  References in these terms and conditions to the Competition Period include any Extended Competition Period, where applicable.
  2. The prize is a pre-paid VISA Gift Card. The value of the prize is $100AUD. The Gift Card will be issued by GiftCardStore (GiftCardStore is issued by Heritage Bank Limited ABN 32 087 652 024 AFSL/ACL No. 240984 Corporate Prepaid Cards Pty Ltd ABN 25 092 828 772 AFSL 509642)Terms and Conditions of GiftCardStore can be viewed here.
  3. Once the winner’s contact details and mailing address is released to the Supplier, the Supplier will order the prize within 15 working days and notify the winner. The supplier accepts no responsibility for loss of the prize once released from the retail supplier GiftCardStore.
  4. The Supplier accepts no responsibility for misuse of the prize which includes, but not limited to, criminal activity once released from the retail supplier GiftCardStore.
  5. To enter, the Participant must share an image of their dream home Lego creation and write in 25 words or less why this is their dream home in the comments section of the Lego Competition Facebook post on the Bingara Gorge Facebook page during the Competition Period.
  6. For the Participant to be eligible to compete in the Competition, the Participant must enter the Competition:
  • within the Competition Period;
  • in the strict manner specified on the entry form for the Competition; and
  • by the method specified on the entry form for the Competition.
  1. Only one entry is permitted from a Participant during the Competition Period.
  2. The best entry will win a Prize.
  3. The Prize is not redeemable for cash.
  4. The Prize is personal to the winner. It cannot be transferred, exchanged or otherwise dealt with.
  5. The Supplier assumes no responsibility for lost, misplaced, destroyed or stolen Prizes once they are claimed.
  6. The judge’s decision is final and no correspondence will be entered into.
  7. By entering into the Competition, the Participant (or its parent and guardian) is/are deemed to have accepted these terms and conditions.
  8. The Supplier reserves the right to request the winner to provide proof of age and identity and eligibility to participate in the Competition. In the event that the winner cannot provide suitable proof, the winner will forfeit the Prize in whole and no substitute will be offered.
  9. The Prize will be mailed directly to the winner. The winner will be contacted via Facebook messenger and asked to provide a mailing address.
  10. Nothing in these terms and conditions is intended to exclude, restrict or modify rights which the Participant may have under any law (including the Australian Consumer Law) which may not be excluded, restricted or modified by agreement (‘Your Consumer Rights’). Subject to Your Consumer Rights, the Supplier is not liable for any loss or damage however caused (including by negligence), suffered or incurred in connection with the Competition or the Prize. Any condition or warranty which would be implied by law into these terms and conditions is excluded.
  11. As a condition of accepting a Prize, the winner (or the winner’s parent or guardian), and any other person(s) sharing the Prize with the winner, may be required to sign legal documentation as and in the form required by the Supplier including but not limited to a further agreement to exclude liability of the Supplier for certain loss, damage or injury arising from the use or participation in a Prize to the extent the Prize is or includes a recreational service or activity.
  12. The Prize is accepted entirely at the risk of the winner, and the Supplier excludes all warranties in connection with the Prize to the extent permitted by law. The Supplier reserves the right to substitute the Prize with a prize of equal or greater value (including where the Prize is unavailable) for whatever reason, subject to approval of the gaming authorities in each State and Territory where required.  The Prize and/or any element of the Prize must be taken as stated and cannot be varied by the winner.  No compensation will be payable if the winner is unable to use their Prize and/or any element of the Prize as stated.
  13. The Supplier will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury, loss or damage suffered or sustained (even caused by negligence) in connection with accepting or using a Prize or participating in this Competition, except for any liability which cannot be excluded by law. The Supplier is not responsible for defective Prizes, lost or stolen Prizes or misuse of the Prize. All entrants release from, and indemnify the Supplier against, all liability, cost, loss or expense arising out of acceptance of the Prize or participation in this Competition including (but not limited to) personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

In the words of Graham Matherson, Director of Jandson Homes:

"25 years ago Terry Sullivan, Gary Sugar and I, having worked together for another builder, decided to start our own building company.

Jandson Homes was born! I still clearly remember setting up business in a back office in Sorrell St, Parramatta. It's hard to believe that was 25 years ago. The business started well, and we soon had over 60 homes on our books. We were heavily involved with the old co-op societies and doing quite a lot of work for NSW Housing, including aged persons units.

We won a few awards and formed valuable associations with many leaders in the industry, many of whom continue to be our friends today Our Homes 2000 project at Cherrybrook with Kim Crestani as architect, was incredibly contemporary for its time.

Whilst starting our business in 1986 seemed easy, the recession of the early 1990's was a an incredibly difficult period which taught us many lessons. We have now traded through three significant downturns in the building industry and believe our conservative approach will keep us in business for many years to come...."
